Terms & privacy
The fine print, written so you can actually read it. Part 1 is what we do with your information. Part 2 is how a job with us works. Using this site or booking a visit means you're okay with what's here. Last updated October 13, 2026.
1. Your information
What we collect
Only what you give us. When you book online or call: your name, phone number, email if you add it, your city, your address if you add it, & what you tell us is going on with the system. If we do the job we also keep the invoice, the written price you approved, & the photos & readings from your equipment so the next visit starts where the last one left off. We don't collect anything from your device in the background.
Where it goes & who sees it
The booking form sends one email to info@aphexmechanical.com. Nothing is stored on the website. From there your details live in our email & in QuickBooks, which we invoice from. Both are accounts with two step sign in, & only the people doing your job can get to them. The services we need to run the company see what they need & nothing more: QuickBooks for invoicing, the card processor if you pay by card, the permit office if the job needs a permit, & Cloudflare, which checks that a booking came from a person & not a bot.
What we never do
We don't sell your information. We don't share it with anyone outside the job. We don't put you on a mailing list unless you ask, & we don't run ads with your data.
Calls & texts
If you give us your number we'll call you about your job: to confirm the booking, give you an ETA, go over the written price, or follow up on the work. We only text you if you've checked the box saying that's fine, & you can stop it any time by replying STOP or telling us on the phone. That's how Florida's Telephone Solicitation Act (F.S. 501.059) works & we follow it.
Photos & video
We film & record almost every job so our customers stay informed, & some of it ends up on this site or on our socials @thinkaphex. What we film: the equipment, the attic, the ductwork, the before & after, the readings. What we don't: your face, your name, your house number, your gate code, or anything that identifies your home, & we don't record conversations. Florida requires everyone in a conversation to agree before it's recorded (F.S. 934.03), so if a tech ever needs audio for a reason, he'll ask you first. If you'd rather we not film at all, tell the tech & we won't.
Cookies & tracking
This site doesn't set tracking cookies. The booking sheet runs in your browser & sends only when you hit Send. The bot check from Cloudflare may set a cookie that does nothing but tell their system you passed. If we ever add analytics, this line gets updated & it'll be the kind that doesn't follow you around the internet.
How we protect it
Florida's Information Protection Act (F.S. 501.171) says a business has to take reasonable measures to protect customer data. Ours: the form strips anything that isn't a name, number, email, address or a note before it's sent; nothing you type is stored on the web server; our email & QuickBooks are locked with two step sign in; nobody at Aphex shares a login; & when a record isn't needed any more it goes.
If something goes wrong
If we ever find out your information got out, you hear it from us directly within 30 days, what happened & what we're doing about it, which is what the same law requires & what we'd want if it were our house.
Your rights
Want to see what we have on you, fix something, or have it deleted? Email info@aphexmechanical.com from the address on the account & we'll take care of it within 30 days. We keep invoices as long as Florida & the IRS require business records to be kept, & everything else goes when you ask.
Kids
The site & the booking form are for adults. We don't knowingly collect anything from anyone under 18.
2. How a job works
The diagnostic
Residential is $95 during regular hours, Mon to Fri 7am to 5pm, & $130 after hours. Commercial is $125 & $160. That pays for the trip & finding out what's actually wrong, & it's due when the tech is done looking, whether or not you go ahead with the repair.
The written price
Nothing gets fixed until you've seen the price in writing & said yes. If the tech finds something else once he's in there, you get a second written price before that gets touched. You decide, every time. Approving a written price, by signing, by email or by telling the tech to go ahead, is the agreement for that work.
Arrival times
Any arrival time on this site, in a text or on the phone is an estimate. We will tell you we are coming & keep you posted if the call before yours runs long. An estimate that slips does not change the price of the work.
Second opinions
Free.
Estimates
An estimate for a new system, a replacement or ductwork is good for 30 days. Equipment prices move, so after that we'll re check it before you sign. An estimate is for the scope written on it; anything outside that scope gets its own written price first.
Your right to cancel
If you sign an estimate at your home for more than $25, Florida gives you three business days to cancel it for any reason (F.S. 501.021 to 501.055). The notice & the form are on the estimate itself. Cancel after that & you owe for materials already ordered & work already done, nothing more.
Permits & the lien notice
We pull permits in any county on every change out & duct replacement. The permit fee is in the price & the inspection is part of the job. For any job over $2,500, Florida's Construction Lien Law (F.S. 713) requires a notice in the contract explaining that people who work on your property or supply materials for it have lien rights if they aren't paid. That notice is printed on every estimate over that amount, & the simple version is: pay us, we pay everyone we brought in, & nobody files anything.
Payment
Repairs & diagnostics are due on the day. Installs are split, part up front & the rest at completion, laid out on the estimate. Card, check, cash or the pay link on the invoice. A balance more than 30 days late can carry a late fee of 1.5% a month, & we'll always call before that happens. If a bill goes unpaid long enough that we have to collect it, the cost of collecting it gets added to it, which Florida allows.
Warranty
Our labor is covered for one year on repairs & installs. Equipment carries the manufacturer's parts warranty, which we register for you on every new system. Other than that, we make no other warranty, written or implied, including any implied warranty of merchantability or fitness for a particular purpose, to the extent Florida law allows.
The warranty doesn't cover damage from power surges, flooding, storms, lightning, someone else working on the system, a repair you were told about & chose to skip, or a system run after we told you to shut it off. A manufacturer's refusal to cover a part under their warranty isn't something we control, but we'll make the call for you.
What we're responsible for
We're responsible for the work we did & the parts we installed. If we break something while we're there, we fix it, that's on us. Beyond that, our responsibility for any job is limited to the amount you paid us for that job, & we aren't responsible for indirect costs like lost business, spoiled food, hotel nights or anything else that isn't the work itself, to the extent Florida law allows.
We're not responsible for parts of the system we didn't touch, problems that were already there & we pointed out, or damage from running a system we told you to shut off.
AirCare
$135 a visit, two visits a year, billed per visit. Nothing paid up front. If your drain line clogs between visits, we clear it at no charge. Cancel any time by calling.
Access & safety
You give us access to the equipment, the attic, the breaker panel & the thermostat. If a space isn't safe to work in (attic over 130 degrees mid day, a loose animal, exposed wiring from previous work), the tech can stop & come back; you won't be charged twice for the trip.
If we disagree
Call us first. Most things get fixed on one phone call. If not, we'll sit down with a mediator in Lee County before anyone goes to court. Florida law governs this agreement, & any claim is filed in Lee County, Florida. Claims against a licensed contractor can also be sent to the Florida DBPR, which licenses us.
This page
We can update it; the date at the top changes when we do. If a court throws out one line, the rest still stands.
